You know that sounds like it is at least PARTIALLY the Judge's fault.
The Judge has a responsibility in such cases to review the evidence he is sealing -- and if the prosecutor LIES to the judge or misrepresents the evidence the prosecutor should get to spend TWICE the time in jail as the supposed defendent. How about the BATF? They pulled a stunt like this about ten years ago in the midwest. Left a whole bunch of guns lying around, in a house with a busted door, and then got the whole case sealed so the owner couldn't sue them into oblivion.
